Terms & Conditions of Sale
Article 1 — Purpose
These Terms & Conditions of Sale ("Terms") govern the contractual relationship between Desert Atmosphere Services ("the Agency", "we"), operating under the name Atmosphere Erg Chigaga, and any person booking a tourism service ("the Customer"), whether directly through the website atmospherergchigaga.com, by email, WhatsApp, or through a partner platform (Viator, TripAdvisor, Booking.com, Airbnb, SimplyBook.me).
Article 2 — Services offered
The Agency offers excursions and stays in the Erg Chigaga desert and surrounding areas: 4x4 tours, camel trekking, overnight camps, stargazing evenings, and combined services with transport from Marrakech, M'Hamid, or Zagora. Details of each service (duration, inclusions, departure points) are specified on the corresponding service listing or in the booking confirmation.
Article 3 — Booking and confirmation
3.1. Any booking becomes final upon written confirmation from the Agency (email or WhatsApp message) and, where applicable, payment of a deposit or full payment according to the terms of the booking platform used.
3.2. The Customer agrees to provide accurate information (number of participants, dates, special requirements, medical or dietary restrictions).
3.3. For bookings made through a third-party platform (Viator, Booking.com, Airbnb, etc.), that platform's own payment terms apply in addition to these Terms.
Article 4 — Pricing
4.1. Prices are listed in Moroccan dirhams (MAD) or in the currency displayed by the booking platform, all taxes included, unless otherwise stated.
4.2. Prices may vary depending on the season, number of participants, and options selected (meals, accommodation, private transport).
4.3. The Agency reserves the right to change its prices at any time; such changes do not apply to bookings already confirmed.
Article 5 — Cancellation and changes
5.1. By the Customer: any cancellation request must be submitted in writing (email or WhatsApp). Refund terms depend on the notice given before the departure date:
- More than 7 days before departure: full refund of the deposit, excluding any bank fees.
- Between 3 and 7 days before departure: 50% refund.
- Less than 3 days before departure, or no-show on the day: no refund.
5.2. For bookings made through a third-party platform, that platform's published cancellation policy prevails if it differs from these Terms.
5.3. By the Agency: in the event of cancellation for safety reasons (extreme weather conditions, regional instability, force majeure) or an insufficient number of participants, the Agency will offer the Customer either a rescheduling of the service or a full refund.
Article 6 — Delivery of services
6.1. Desert tours involve travel through remote areas, on unpaved tracks, sometimes at night. The Customer acknowledges and accepts the conditions inherent to this type of environment (heat, sand, lack of phone signal in certain areas).
6.2. The Agency reserves the right to adapt the itinerary or program for safety reasons, without this constituting a breach of contract.
6.3. The Customer must follow the safety instructions given by guides and drivers throughout the excursion.
Article 7 — Health and insurance
7.1. The Customer is responsible for confirming their physical fitness to participate in the activities offered (camel trekking, 4x4 travel on rough terrain).
7.2. The Customer is strongly advised to take out travel insurance covering cancellation, repatriation, and medical expenses before departure.
7.3. The Agency disclaims any liability for pre-existing health conditions not disclosed at the time of booking.
Article 8 — Liability
8.1. The Agency undertakes to use all reasonable means to ensure the safety and quality of its services.
8.2. The Agency's liability cannot be engaged in cases of force majeure, acts of a third party, or fault of the Customer.
8.3. The Agency cannot be held responsible for the loss, theft, or damage of the Customer's personal belongings during the excursion.
Article 9 — Complaints
Any complaint must be submitted within 15 days of the end of the service, by email to contact@atmospherergchigaga.com or desertatmosphereservices@gmail.com, together with supporting documentation.
Article 10 — Governing law and disputes
These Terms are governed by Moroccan law. In the event of a dispute, the parties will make every effort to reach an amicable resolution before pursuing any legal action. Failing that, the competent courts of Zagora or Marrakech shall have exclusive jurisdiction.

Privacy Policy
1. Introduction
This privacy policy explains how Desert Atmosphere Services ("the Agency") collects, uses, and protects the personal data of visitors to the website atmospherergchigaga.com and of customers of its services.
2. Data collected
We collect the data that you voluntarily provide to us, in particular:
- Name, surname, email address, phone number (via the contact or booking form);
- Number of participants, travel dates, preferences or special requirements;
- Messages exchanged via WhatsApp, email, or partner platforms (Viator, TripAdvisor, Booking.com, Airbnb, SimplyBook.me).
We do not collect banking data directly: online payments are processed by the relevant third-party platforms, in accordance with their own security policies.
3. Use of data
Your data is used solely to:
- Process and confirm your bookings;
- Communicate with you before, during, and after your stay;
- Respond to your information requests;
- Improve our services, subject to your consent, for statistical purposes.
The website's booking form uses the EmailJS service to send your request directly to our address contact@atmospherergchigaga.com. Your data is not stored in a database on the website.
4. Sharing of data
We do not sell or rent your personal data to third parties. Your data may only be shared with:
- Our operational partners directly involved in your trip (drivers, guides, accommodation providers), strictly to the extent necessary to organize your stay;
- The booking platforms through which you made your reservation (Viator, TripAdvisor, Booking.com, Airbnb, SimplyBook.me), in accordance with their own privacy policies.
5. Data retention
Your data is retained for as long as necessary to process your request, then archived for a reasonable period for commercial follow-up and accounting obligations, unless you request its deletion.
6. Cookies
The website may use technical cookies necessary for its operation (for example, to display third-party widgets such as TripAdvisor) as well as, where applicable, audience measurement cookies. You can configure your browser to refuse cookies, which may affect certain features of the website.
7. Your rights

8. Security
We implement reasonable measures to protect your data against unauthorized access, loss, or disclosure. However, no data transmission over the internet is completely secure.
